Look At Us Events

Section 1.

Interpretation:

In this Section and your Contract Agreement with us the following words have the following meanings:

BOOKING FEE / Deposit Payment: means a non-refundable payment of £100 of the Total Fee stated on your contract payable by You to Look At Us Events. 

DATE OF VENUE: means the day on which the planned event will take place.

EVENT means the purpose or reason for the planned social occasion.

Contract means any supporting documentation agreed between the Parties which form part of this Agreement; which shall include (but not be limited to) details of:

You as the Client:

The Event or Venue where You require Us to provide and set-up the Decor.
The Date of the Event.
The Decor you require us to hire to you.
Any other relevant information.

Remaining Balance means payment of the Total Fee agreed by the due date. 

Decor / Decoration means all the products / equipment you have agreed to hire from ss for the agreed hire period detailed within the Contract. With Weddings this is usually an install / set up in the morning and a de-rig / collection early the following morning or the same night but no later than 12:00am (An additional £100 will be added to your contract for any same night collections and limited to 1 hour time band to remove all decor. If this time exceeds, we reserve the right to charge £50 per 30 minutes thereafter.

TOTAL FEE / Agreed Price means the total amount agreed between the Parties and payable by you to us for consideration of hire of the Decoration / Props and the associated set up services we provide to you.

DELIVERY means, we reserve the right to charge additional delivery costs if more than 10 miles radius from our Home Base in Liverpool. Depending on your venue this cost can vary and we will calculate travel time at £0.45 per mile plus fuel costs at £50 per trip from A to B. We waiver this charge, depending on the package or promotion we may or may not offer at any given time. The Delivery will be shown as a separate cost on your booking.  

VENUE means the space, location, or place where the Props are to be delivered and set up

Section 2.

Please read this Agreement carefully as it constitutes a legally binding contract between Look At Us Events and you the client.

This Agreement outlines the standard contractual terms and conditions that shall apply to the hire of our props / venue decor we provide. You agree to hire from Look At Us Events; the details of such hire and set up services are incorporated within the Contract agreed by the Parties.

The Contract comprises part of the provisions of this Agreement and references to this Agreement shall, include references to the Contract No.

You acknowledge that You have read, understood, and agree to be bound by all of the terms and conditions contained in this Agreement.

Full payment must be made no later than 4 weeks before the date of the Event specified within the Contract. The final date will be shown on your contract.

To confirm your booking with us a non-refundable Deposit / Booking Fee of £100 must be made at the time of acceptance / booking. For clarity and the avoidance of doubt if payments are not received on the dates specified then your contract with us, your contract / agreement with us may be cancelled with the loss of your non-returnable Booking Fee. Furthermore, you may be invoiced a cancellation charge in accordance with clause 5.

All payments including Deposit's need to be paid to the Bank Account stated on the quote and booking agreement / contract.

Section 3.

Delivery of Decor / Props

On the Date of the Event, we will deliver Props to the Venue. The Props / Decor shall be delivered as per your specifications and other instructions specified and agreed within the contract. 

We will speak with the venue prior to your wedding / event and arrive approximately 1-2 hours before the Wedding / Event is scheduled to begin, and set up the Props. (This time can vary and could be earlier, depending on the venue access and will be arranged locally. You agree to provide us with access to the Venue, and any other help, permissions or co-operation needed to ensure we fulfill our obligations specified within your contract. If for any reason we are not allowed access, this will be addressed immediately with the person who has made the booking. 

After the Event has concluded, we require you to secure with the venues there permission for  to remove the Wedding Decoration / Props from the Venue. You accept that this could be on the Date of the Event or the day after the Date of the Event. You will be responsible for the hire goods for the agreed duration of hire. 

Section 3a. Fees and Payments

a) The Total Fee for the hire and set up of the Props shall be payable by you the client / customer to us in accordance with the Payment Plan specified within the Contract but for clarity is as follows:
b)You agree to pay the Booking Fee directly to us on the date of signing the Order Form. A written signature is not always necessary, as we will accept electronic acceptance via email. Once you agree to the quote and pay the deposit, this is then legally binding contract between you the client / customer and us - Look At Events.  
c) All payments must be made to Look At Us Events through any of the following payment methods:  Bank Transfer is our preferred method or other agreed payment payment methods we offer. Unless otherwise specified in this Agreement, all payments are final and non-refundable.
d) We shall not deliver the Props until the Total Fee is paid. .
e) We offer packages at a discounted price and the products within that package cannot be changed unless we agree to do so and your contract reflects this. Our current package offers up to 8 x Table Centrepiece's and should you have less tables, the price will not be reduced.

f) Our packages prices advertised will be honoured, but subject to availability. We can offer promotions from time to time, however if you have already secured your booking with us, that is the price which has been agreed at point of agreement / contract. We will also review our packages on a regular basis and will apply RPI accordingly on a yearly bases, but is reviewed within our team.

4. Agreement Term (Duration)
Unless otherwise specified, this Agreement will take effect on the date you agree to the contract (the “Effective Date”), and shall continue in full force and effect until the Event has concluded.

We will send you a quote prior to you agreeing to the contract. Upon receipt of the £100.00 deposit then the contract becomes binding. We accept email agreement as a confirmed contract by you the customer and once you have paid the deposit, you are agreeing to our terms and conditions. 

You have a 7 day cooling off period after you have paid your deposit, and any monies paid will be refunded back to you, should you wish to cancel. After the 7 days has lapsed, then we reserve the right to withhold any monies paid and our terms and conditions will apply. 

5. Event Changes / Cancellations
a) Any request for a change in the Event Date must be made at least 12 weeks in advance of the original Event date. Change is subject to Decor / Props availability, and you will receive receipt of a new Contract.
b) If you wish to cancel your booking with us, you must notify us as soon as possible in wrting, we will accept an email, but not via social media or text. You acknowledge and accept that the Booking Fee / Deposit payment is non-refundable. We shall review your request to cancel and should additional payments have been made, we will refund all other fees already paid only if we are able to secure another booking from another customer for the same date. We will use our discretion, however we may and can enforce the below charges if we fail to find a replacement customer then the following Cancellation Fees shall be payable by you:

Cancellation Fee Payable by You to Us

Within 6 months of Event 50% of Total Fee
Within 3 months of Event 75% of Total Fee
Under 1 month of Event 100% of Total Fee

You may also be responsible for any refund charges.
c) Once final payment of the Total Fee has been made, amendments cannot be made to your original order. However, additional items can be ordered once you have accepted a new quote.
d) All requests for Event changes or cancellations must be emailed to: lookatusevents@gmail.com

6. Permits
You shall be responsible for acquiring all permits and necessary permissions for the Event to take place at the Venue where we shall deliver and set up the Decorations / Props. You must inform us if parking / loading restrictions are in place. If you fail to do so, we reserve the right to cancel the booking if we cannot unload within a reasonable walking distance, or any parking fines that may arise, we reserve the right to pass these costs onto the client / customer who made the booking. 

7. Decor / Props Care and Damages
a) You shall be responsible for the overall care of the Props. You agree not to allow any of your guests to climb or hang from the Wedding Decoration / Props, attach any non-authorised items to any of the Props or mishandle any of the Props’ place any of the Props near direct heat or manually move the Props’ without Look At Us Events authorization and help or informed us prior. We will be available after your ceremony to assist venue staff move items for your wedding breakfast, but we will not return after your wedding breakfast. Should you require us to do so, we will charge an additional £100 to cover staffing costs, and depending on the venue we may also charge additional travel / fuel costs. These details will be discussed at point of booking and clearly shown on your agreement / contract with us. 
b) You agree that you will responsible and accountable for all and any costs (including consequential damages/losses) for any damages and/or losses caused to the Wedding Decoration / Props at your chosen venue.

We shall deem, at our sole discretion, whether the damage or loss was caused by your failure to follow the instructions specified in Section 7(a) above or you &/or your guests have abused the Props , and/or the Props have been stolen and/or the Venue suffered an unforeseeable disaster (fire, floods, rain, earthquake etc.) causing damage or loss to the Props. You can cover yourself with wedding insurance if this is something you feel you need to consider or do. 

8. Indemnification
a) You agree to defend, indemnify and hold harmless, and its employees from and against any and all losses, liability claims, damages, injuries, demands, actions and causes of action whatsoever, arising out of or related to the presence of the Props at the Venue.
b) You agree to assume all costs and expenses of every kind and nature, including legal fees and

disbursements arising out of and in connection with your hire of the Decoration / Props and their presence at the Venue.

You agree to indemnify us for all, and any losses and damages caused to the Props and including consequential losses suffered by us, through any action or inaction carried out by You or Your guests.

9. Limitation of Liability
a) Look At Us Events shall not be responsible for any direct, incidental, or consequential damages causing either bodily injury or property damages, regardless of the cause, arising out of or related to your hire of the Props and their presence at Your Event at Your chosen Venue.
b) Notwithstanding any language to the contrary contained in this agreement, Look At Us Events’ liability to you shall not exceed the total of any payments you have made for the hire of the Props and any associated set up services.

10. Governing Law
a) This Agreement shall be construed and enforced according to English Law.
b) Any dispute or difference which may arise in relation to any matter arising under this Agreement, shall be settled amicably and in good faith between you and Look At Us Events, prior to resorting to arbitration.

11. Severability
If any term of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then this Agreement, including all of the remaining terms, will remain in full force and effect.

12. Entire Agreement, Modification;
This Agreement constitutes, together with the associated Contract, the entire understanding between You and Look At Us Events with respect to the hire of and set up of Props, and may be modified only by a writing signed by both you and a representative of Look At Us  Events.

13. Counterparts
The exchange of copies of this Agreement and original signatures by electronic mail transmission shall constitute effective execution and delivery of this Agreement in place of the original Agreement for all purposes.
